Litigation and Enforcement

Our Clients rely on us, to fully protect their intellectual property assets and to enforce them. We work with the firm’s dispute resolution practice, in representing clients as plaintiffs and defendants in claims involving patent, trademark and copyright infringement, and other IP-related violations at Superior Courts in Nigeria.

Transactions

We regularly advise our clients on the best and practical approach towards penetrating the market through strategic business combinations and alliances. We work regularly in conjunction with other practice areas within the firm on transactional matters, which includes the negotiation and drafting of domestic and international license and transfer agreements, due diligence reviews and intellectual property ownership strategies in connection with mergers, acquisitions, divestures, joint ventures and corporate reorganizations.

Representative Experience

  • Advising a logistics company on its design, installation and delivery of cash deposit terminals, Automated Teller Machines on it’s payment services project with Nigeria Inter-Bank Settlement System Plc.
  • Advised a broadcasting company in respect of the setting up and establishment of radio stations. Our advice included registration of all entities, liaison with the Nigerian Broadcasting Commission, review of the Broadcasting Code and advice on operating the business, obtaining trademark registration.
  • Advised a Client, providing online payment solutions, in respect of its set up and establishment, obtaining post-incorporation licenses and approvals, registration of its trademarks and patents and drafting of contracts with payment aggregators and content providers.
  • Assisted an oil and gas company in registration of its Trademark.
  • Advised a client on the infringement of its trademark and sale of counterfeit products of a subsidiary of the American Garden brand. Through extensive collaboration and interactions with the National Agency for Food and Drug Administration (NAFDAC), we were able to abate further infringement.
  • Advised a UK company on their software licensing agreement with a Nigerian company, including compliance with Nigerian tax laws and NOTAP registration.
  • Together with WIGGING, LLP, we advised a payment solutions provider, on the globalization of its business by expanding into Mauritius and creating subsidiaries of the Mauritius Company across Kenya, USA and the United Kingdom.
